DepEd Public School Teachers Exigency of Public Service

The very reason why the approval of the Division Superintendent is sought before requesting teachers’ services during Saturdays, Sundays, holidays, or Christmas and Summer vacation is for the grant of vacation service credits. This is so because teachers are not paid during these days.

Teachers are entitled to receive Christmas and long summer vacation pay in the form of proportional vacation pay (PVP) because they are NOT entitled to the usual vacation and sick leave with pay and other special leave privileges granted to other government employees. Therefore, nobody should think that teachers are receiving salaries during these period while doing nothing. The compensation they are receiving is actually their earned leave privileges.

Service credit is given for work beyond regular functions or beyond regular work hours/days where payment of honorarium or overtime pay is not possible.

However, there are activities where teachers need to report to school to submit their delayed reports. Finishing reports is one of the activities not eligible for the grant of service credits (DO 53, s. 2003) because this could have been completed by the teachers before the school year ends. – Margarita J. Attached is a MEMORANDUM DM-PFO-2018 from JESUS L.R. MATEO, Undersecretary for Planning and Field Operations, dated December 5, 2018, entitled “Clarifications on the Applicability of DepEd Order No. 49, s. 2018 to Public and Private Schools” which is self-explanatory, for the information, guidance, and compliance of all concerned.

Clarifications on the Applicability of DepEd Order No. 49, s. 2018 to Public and Private Schools

This Office has been in receipt of queries from various stakeholders, both from the public and private sectors, regarding the implication of DepEd Order (DO) No. 49, s. 2018 entitled Amendments to DepEd Order No. 25 s. 2018 on the attendance of public and private school teachers. In this regard, the Regional Offices and Schools Division Offices are hereby instructed to ensure dissemination of the herein clarifications.

On the applicability of DepEd Order No. 49 s. 2018 to Public Schools

DO No. 49, s. 2018 moves the start of the Christmas vacation for learners from December 22 to December 16, 2018 to enable them to spend more quality time and strengthen emotional bonds with their families. In the same way, Christmas vacation for teachers shall also start on December 16, 2018. However, in the exigency of public service, teacher’s may be required to report and render services from December 16 to 22, 2018, which shall be compensated with the equivalent vacation service credits, as per DO No. 53, s. 2003.

Public School Teachers Exigency of Public Service

Note that requests to require the attendance of public school teachers during the said period must satisfy the following conditions:

  • A letter-request is submitted by the school head to the Schools Division Office.
  • Sufficient justification is provided to establish that exigency of public service exists.
  • The request is duly approved by the Schools Division Superintendent (SDS).

For purposes of this issuance, “exigency of public service” refers to a situation where service is urgently needed and where any delay in its execution and delivery will adversely affect the outcome of the service to clients and its effective and efficient delivery.

On the applicability of DepEd Order No. 49 s. 2018 to Private Schools

The Department encourages private schools to adopt the revised school calendar. However, paragraph 2 of DO No. 25 s. 2018 entitled School Calendar far School “Year 2018-2019 provides that private schools may deviate from this school calendar as long as the minimum number of class days is completed and the provisions of Republic Act No. 7797 or the Act to Lengthen the School Calendar From Two Hundred (200) Days to Not More Than Two Hundred Twenty (220) Class Days are observed. In like manner, the attendance of private school teachers shall be the prerogative of the school’s management

May question lang po ako, with regards to letter request of the SH to the SDS in times when the term exigency of service is gravely abused, do these SHs really need to make such letters addressed to the SDS for approval of the teachers’ exigency of service? Please enlighten me on the matter. Thanks, Sir.

  2. pwede bang di ummattend sa mga seminars na ngayon mo lang nalaman tapos naka schedule na ang vacation ng family ko kasama ako, nakapabook na ng mga needed transportation and mga etrinaries.
