How Do I File an Administrative Complaint Against DepEd Teaching and Non-Teaching Personnel?

HOW DO I FILE AN ADMINISTRATIVE COMPLAINT AGAINST DEPED TEACHING AND NON-TEACHING PERSONNEL

For complaints, it is hereby reiterated that Section 5. Content of Complaint, DepEd Order No. 49, s. 2006 as quoted below shall be followed:

“Section 5. Content of Complaint – A complaint shall contain the following:

a. Full name and address of the complainant

b. Full name and address of the person complained as well as his position and office in the Department of Education

c. A narration of the relevant and material facts which should show the acts or omissions as allegedly committed by the person

d. Certified true copies of documentary evidence and affidavits of his witnesses if any; and

e. Certification or statement on non-forum shopping”

The conduct of clarificatory hearings would depend on the gravity of the offense, and pieces of evidence submitted, taking into consideration the health and safety of the investigators and persons complained of and the person filing the said case (COVID-19) pandemic.

While awaiting further guidelines from the region or central office for administrative formal hearings, those cases filed wherein the person complained of has been notified and given ample time to file his/her Answer already, the submission of factfinding/preliminary investigation report is on the discretion of the Investigator/s whether or not to conduct further clarificatory hearings.

DEPED FILING OF COMPLAINTS/APPEALS/MOTIONS FOR RECONSIDERATION

Schedule of Availability of Service:

Monday – Friday

8:00 a.m. – 5:00 p.m. NO noon break

Who May Avail of the Service?

  • Complaint – any person
  • Appeal – parties adveresly affected when decisions of the Regional Director is a penalty exceeding thirty (30) days suspension, or fine in an amount exceeding thirty (30) days salary.
  • Motion for Reconsideraion- Party adversely affected by a decision stemming from the Central Office

What are the Requirements?

Complaint

  • Full name and address of the complainant
  • Full name and address of the person complained of as well as his position and office in the Department of Education
  • A narration of the acts or ommissions as allegedly committed by the person
  • Certified true copies of documentary evidence and affidavits of witnesses if any
  • Certification of non-forum shopping

Appeal

  • Notice of appeal which shall specifically state the date of the decision appealed from and the date of receipt thereof
  • Three(3) copies of appeal memorandum containing the grounds relied upon for the appeal
  • Certified true copy of the previous decision, resolution, or order appealed from
  • Certified copies of the documents or evidence

Motion for Reconsideration

  • Motion for Reconsideration
  • Certified true copy of the previous decision, resolution, or order appealed from

Note: For the submission to be considered a formal complaint, appeal, or motion for reconsideration, all required documents must be submitted. If documents are incomplete, documents will be treated as formal communications, the actions to which will depend on the discretion of the office, pending compliance of all requirements.

Hi, pwede po ba icomplain ung head teacher na laging nagpapagawa na hindi related sa school, like example ung assignment po ng anak nya, online birth certificate nya, online passport appointment. Aside pa po don, lagi po pinapagawa ung report nya sakin as head teacher, example po ung MPS Consolidation, ung MEMOs, Accomplishment Report Card ng Department namin, na nag ccause npo ng inconvenience sa role ko as as teacher, hindi lang po yon, ung isang kasamahan ko po, ginawa n nyang personal alalay nya, na pati foods sya ang bumibili at ipinapahatid pa nya food ng anak nya.

  2. Paano po makakapag-file ng complaint sa head teacher na nag-post ng mga below the belt na salita at nagsabi pa na umalis sa DepEd? Personal attack na po kasi ang naramdaman ko sa mga sinabi niya at hindi ko na kakayaning makatrabaho ang ganung klase ng head teacher na imbes na mag-motivate sa tao niya, ay siya pa ang dahilan at nagtutulak sa guro na mag-resign. Noon ding nagpapapirma ako ng clearance, ayaw niyang pirmahan dahil gusto niya iwan ko yung mga personal kong ginawa na video lessons, PPT presentations ng lessons, Word file ng mga dokumento gaya ng WHLP para di na gagawa yung mga teachers niya at madali nilang mabubura yung pangalan ko sa “Prepared by”. Inupload ko naman sa Google Drive lahat ng mga soft copy ng IMs at iba pang files ko pero dahil ang sumbong sa kanya ng mga “assistants” niya na PDF files daw ang inupload ko kaya di nila maeedit (wala akong inupload na PDF file maliban sa mga na-download ko na soft copy ng modules na galing sa DO), di daw niya pipirmahan ang clearance ko at sinabihan pa akong “pabigat” at “wala sa ayos”.

  3. Hi po, good evening. Can I ask po for guidance if pwede po akong magfile ng complaint against sa tita ko po na public teacher? Niloko po nila ako ng Tito ko regarding sa selling ng land property na nakapangalan sa lolo mo and sa akin po. Ayaw din po nilang magbigay sa akin na mga legal documents like deed of sale, original copy of title. Supposed to be po ay hati kami sa napagbentahan. P1,300,000.00 po ang selling price at ang naibigay Lang nila sa akin is nasa P200,00.00 po. Ang sabi nila hindi pa daw po nagpapadala ng payment yong buyer pero almost fully paid na po pala. Hindi po kasi sila nakikicommunicate sa akin. Sa manila na po ako naka-base at ipinagkatiwala ko lang po sa uncle ko lahat ng transactions. Sana po ay ma-assist niyo ako kung ano po and dapat kong gawin at pano po ako makapag-file ng complaint. Salamat po.
